By using LIHosting services, you agree and acknowledge that the services are provided on an “as is” and “as available” basis, without any warranties or guarantees of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement. LIHosting does not warrant that the services will be error-free, uninterrupted, secure, or that any defects will be corrected. No advice or information obtained from LIHosting, whether oral or written, shall create any warranty not expressly stated in these terms.
Limitation of Liability:
To the fullest extent permitted by applicable law, in no event shall LIHosting, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if LIHosting has been advised of the possibility of such damages) resulting from the use of or inability to use the services, or any other matter relating to the services.
In any case, LIHosting’s total aggregate liability for all claims arising out of or in connection with the services shall not exceed the amount paid by you for the services during the twelve (12) months immediately preceding the event giving rise to the claim. The limitations of liability set forth in this section shall apply regardless of the form of action, whether based on contract, tort, negligence, strict liability, or otherwise, and whether or not LIHosting has been advised of the possibility of any such damages.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.
